Federal legislation to Ban Mandatory Arbitration of Employment and Consumer Claims
Both the federal House of Representatives and the Senate are introducing legislation that, if passed, will prohibit mandatory arbitration of employment and consumer claims. The bills discuss how mandatory arbitration clauses in these areas are unfair to the employee and consumer, who are usually not even aware of these clauses because of how they are burried in employee manuals or card holder agreements and the unequal bargaining powers that are inconsistent with the historical reasons for arbitration which is grounded on equality of the parties. Wisconsin's own Senator Russ Feingold is sponsoring the Senate version.
